By accessing or using the Ember mobile application and website at www.ember-hub.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
We may update these Terms from time to time. Continued use after changes are posted constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years old to use Ember. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
3. User Accounts
To use most features of Ember, you must create an account. You agree to:
- Provide accurate and complete registration information
- Keep your login credentials secure and not share them with others
- Notify us immediately if you suspect unauthorized access to your account
- Be responsible for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to use Ember to:
- Harass, bully, threaten, or intimidate other users
- Post content that is hateful, discriminatory, sexually explicit, violent, or illegal
- Impersonate another person or misrepresent your identity, age, or affiliation
- Spam, advertise, or promote products or services without our prior written consent
- Attempt to gain unauthorized access to the Service, other accounts, or our systems
- Use bots, scrapers, or automated tools to access or collect data from the Service
- Upload malware, viruses, or other harmful code
- Violate any applicable local, national, or international law
5. User Content
You retain ownership of the content you create and share on Ember (posts, photos, comments, etc.). By posting content, you grant Ember a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Service.
You are responsible for the content you post. We do not endorse user content and are not liable for any content posted by users.
We reserve the right to remove content that violates these Terms or our community guidelines, at our sole discretion.
6. Events & Meetups
Ember provides tools for users to organize and join real-world events. You acknowledge that:
- Ember does not organize, supervise, or control any user-created events
- Participation in events is at your own risk
- You are responsible for your conduct and safety at events
- Event organizers are responsible for their events and any representations made
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Please review it carefully.
8. Intellectual Property
The Ember name, logo, design, branding, and all software, code, and visual elements of the Service are the intellectual property of Ember and are protected by applicable copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our Service, nor may you reverse engineer or attempt to extract the source code of our software.
9. Termination
You may delete your account at any time from within the app (Settings → Delete Account) or by contacting us at [email protected]. See our Account Deletion page for details.
We may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in behavior that harms other users or the Service, or for any other reason at our sole discretion.
10. Disclaimers
The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee the accuracy, completeness, or reliability of any content on the Service, including user-generated content.
11. Limitation of Liability
To the maximum extent permitted by law, Ember and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to:
- Loss of data, profits, or goodwill
- Injury or harm resulting from user-organized events or meetups
- Unauthorized access to your account or personal data
- Any third-party content, conduct, or services
12. Indemnification
You agree to indemnify and hold harmless Ember from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
